In the first part of the paper, the author presents a table on the legal aspects of downloading music. In the second part, the author explains the legal elements of a contract and how they are based on case law. The paper refers to the case "Roark v. Stallworth Oil and Gas Inc".

From the Paper:

"In relation to the simulation, the two organizations processed the offer that was based on a mutual agreement to fulfill their respective obligations. Yet, the contract failed to be effective when issues with deliverables began to arise. Furthermore, while the purpose of the contract was legal, the considerations of the parties were not equally contemplated, especially when the receiving company could not proceed with their business practices as intended. Finally, the competency of both parties was initially evident. However, the ability of both parties to successfully fulfill their obligations realistically was not apparent. Therefore, in order to resolve the issues that affect both companies at this time it is necessary to create revisions to the initial contract that will satisfy the business needs of both organizations.
"The revision to the contract should include elements of performance, change control, communications and reporting, project structure, and dispute resolution. These elements will effectively address the concerns of the company leaders and lead to more effective business practices, which will reduce loss and lead to positive outcomes."
