This essay is a case brief with additional comments focusing on certain issues in the case, dealing with a particularly gruesome death by starvation and dehydration of a ninety-two year old man who put himself in the care defendants, who systematically hid him while they neglected him while they looted his bank account, and when that was exhausted simply allowed him to starve and die of thirst. From the Paper:"Defendants had a contract to provide the deceased, an elderly invalid, with care in their home. Instead, they isolated him in a rural site and deprived him of food and water, causing his death. Charged with murder, they contended that they had no legal duty to care for him. The jury ruled that the defendants had a contract to care for the deceased, and that this imposed on them a legal duty to provide such care, so that the failure to do so amounted to third degree murder. Found guilty, the defendants appealed."
