Description:

This paper first explains that the right to privacy does not appear in the U.S. Constitution, but the U.S. Supreme Court has said that several of its amendments create this right. Next, the author reviews laws of search and seizure and of surveillance as applied to the police, school officials and security personnel. The paper notes that video surveillance cameras provide security and hard evidence; however, the use of such cameras has raised a great deal of legal debate.

"Surveillance is utilized by law enforcement as a tool to fight crime, but there is much controversy. Law enforcement must have approval from the court to gain access to communication by use of wiretaps, and phone tracers. In 1968 Congress implemented the Communication Act, as a means to balance personal rights and public interest, which established statues on wiretapping. ...
"Police must have probable cause and show proof that regular investigative techniques cannot produce a better result than using surveillance methods."
