This paper discusses how the legal and political structure of ancient Rome can be gleaned from the historic writings of Polybius, especially from his "The Rise of the Roman Empire". It analyzes how he discusses his philosophy of government and how he sees this working out in Rome. It also looks at how he views the specific roles of different officials both elected and otherwise, the formation of law for Rome and how the legal structure does and does not work in practice. It evaluates how the book shows the principals on which the Roman Empire was founded and the typical career of a Roman Senator in the third and second centuries B.C.

"The career of a Senator would have varied somewhat from one to another, but there were certain commonalities. In the beginning, the Senate consisted of 300 members, all of whom had served as consuls. The body was thus made up primarily of patricians, but this changed so that by the time of Polybius, plebeians had gained admittance to the Senate. There was a series of political offices which might lead to the Senate, though they were not required in later periods. The lower offices included Quaestor, Aedile, Praetor, and then Consul. The Senate included advocates and prosecutors, in keeping with the judicial and investigative functions of the body. Polybius notes that the Senate seems aristocratic, and the nature of this aristocracy is evident from the original requirement that every member of the Senate first serve as Consul. Consul is the highest position one could achieve in government."
