Paper Summary:
This paper discusses the subject of legal philosophy and the development of concepts that can change how justice functions, with the hope of bringing improvement to society and civilization. It explains that few topics make this clearer than investigating the Holocaust and moral justice and concludes that much of the current legal system needs to be amended and dismantled.
Outline:
Human Rights and Moral Justice
The Lack of Morality
Conclusion
From the Paper:
"Legal philosophy also has the power to reveal that attorneys can find ethically viable and nourishing paths for their work. With this goal in mind, legal theory on human rights and the Holocaust brings up many critical concerns. Understanding this, it becomes apparent that the substantial points of ethical and moral lawyering have never been more clearly demonstrated than in contrasting how law functioned in 1933 to 1945 Germany and Vichy France with, in truth, almost any other possible outcome.
"Putting these principles, which are intended to prevent the failure of justice, into practice is challenging. Understanding how the law allowed French and German lawyers to help perpetuate the systemic mass murder, which was sponsored by their governments, requires taking into account the complexity of the philosophical questions that arise in viewing the gap between law-based justice and moral justice."
