The paper describes the attempts by the church and later the crown to limit the instances of racial mixture in Latin America, but discusses how sexual behavior in the Western Hemisphere remained virtually unchecked at the end of the eighteenth century. The paper shows how the regulation of marriage by the Real Pragmatica resulted in greater frequency of illegitimate births, as marriage to different classes became less desirable, but sexual contact did not.

"Miscegenation during the colonial period in Latin America occurred to a degree not duplicated anywhere else in the world, despite Spanish efforts to create a racially segregated society similar to that of Europe in the Western Hemisphere. The Regimen de Castas, a rigid system based on blood quantum, were increasingly undermined by the expansion of mestizaje (the mixture of Spanish and Indian blood) and a general ambiguity in the colonies towards sexuality. Attempts to regulate marriage and sexual behavior were the responsibility of the Catholic Church until 1778, when the Real Pragmatica, issued by the Bourbon royalty, transferred juridicial control to the state, granting the institution of marriage pre-eminence by placing it under civil law."
