The paper discusses the justifications for incarcerating criminals that apply to capital punishment too. The paper then looks at the arguments against capital punishment on moral grounds that concern the methods of its implementation, the disproportionate prosecution based on race, social status, or other demographics, and the prospect of erroneous conviction. The paper concludes that perhaps the strongest criticism of capital punishment is that misapplication of the death penalty cannot be reversed once it is imposed and carried out.

"Capital punishment is currently authorized by the penal laws of most American States, but nevertheless, is the subject of substantial controversy on various grounds. According to some critics, capital punishment is a violation of the constitutional protection against "cruel and unusual" punishment (Schmalleger, 2001). Even among those who support capital punishment for its deterrent value, legitimate issues have been raised concerning both its specific methods of implementation as well as its disproportionate impact on minority defendants. In that regard, capital punishment raises another fundamental constitutional issue: equal protection (Dershowitz, 2002)."
