Paper Summary:
This paper discusses how the conventions of ministerial responsibility, as well as the conventions of political non-partisanship and public service anonymity, are greatly affected by broad public access to information, and this has influenced the breakdown of these conventions in Canada. The paper also discusses the culture of secrecy in the public service, which has undermined the authority and accountability of ministers and increased public suspicion of politicians. The paper explains that the definition and the application of constitutional conventions are not legally binding, and therefore they tend to change over time in accordance with the shifts in society.
From the Paper:
"Since the definition and the application of constitutional conventions are not legally binding, they tend to change over time in accordance with the shifts in society and politics without there being formal pronouncements, or even notice, of the change. Because of this, many critics of the doctrine of ministerial responsibility, assert that it has become a myth. When observing the bedrock assumptions that have been based on merit, non-partisanship, and anonymity, the myth of ministerial responsibility becomes increasingly clear."
