Specifically, the writer argues that, although perspectives are mixed about the use of the death penalty in the U.S., viewed from both Kant and Mill's perspectives, it appears to be a practice that does more harm than good to society.

"The death penalty has been used by societies since ancient times, for various types of crimes and in various forms of execution. In societies based on scriptural rules regarding the death penalty for various crimes, the civil codes and laws were often tied up in religion and the need to provide a public spectacle. Since independence there has been a divide within the U.S. in terms of support for the death penalty, depending largely on the legal culture and public opposition to state-sponsored execution, but philosophical and moral issues are also prevalent, as in the case of the recently overturned execution of the mentally disabled in the U.S. This case involves moral and philosophical issues as well, because the ultimate price that a person can pay is their life. Other systems around the globe have their own systems of death penalty, and many of these societies have also abolished the practice."
