Paper Summary:

The writer of this paper analyzes E.R. Jungman's article "Beyond All Doubt" which focuses on the inability of the justice system to differentiate between the innocent and the guilty in capital punishment trials. This informative paper contains statistical data relating to death penalty crimes as well as the steps involved in a capital trial case including the investigation and appeals process. Also discussed is the right to due process as per the 5th and 14th amendments. The author's purpose for this article is to convey that the current system is flawed resulting in innocent people being sentenced to death.

From the Paper:

"Jungman states that only 5 percent of inmates were able to prove their innocence and were set free, for others who have filed appeals will not be as lucky and shows the defects of the Capital punishment system. She contends that the burden of proof of "Beyond Reasonable Doubt" is not sufficient. And the flaws suggest a need for a stricter standard for death punishment.Using evidence from previous cases of appeals and death penalty and citing the constitutional amendments she gives a partial solution to changing the system."
