This paper explains that the governments in Europe and in the United States are approaching the complex issue of online privacy with increased legislation. The paper first looks at U.S. legislation, such as the Electronic Communications Privacy Act (ECPA), Foreign Intelligence Surveillance Act (FISA), Stored Communications Act
and the California Online Privacy Protection Act. In comparison to this U.S. legislation, the paper then looks at the European privacy law, which essentially equates to data protection as provided by the Data Protection Directive 95/46 (DPD).
From the Paper:
"Any agreement between the United States and the European Union seems unlikely for now. A prime example of the dissidence between the American and European point of view is the dispute surrounding the international banking network- SWIFT. SWIFT has provided the United States government with confidential banking records in order to facilitate the governments attempt to track terrorist activities. The EU argues that by doing so SWIFT has violated DPD regulations. The disagreement over SWIFT is fundamentally a conflict of two opposing sets of values."
