This paper provides a book review on Neely's work and presents a short bio of the author himself. It shows how, in "How the Courts Govern America", Neely makes a convincing case that the judicial system in the United States, at present, is what in realism, defends an individual from the incursion of the executive branch, at the same time as defending society from the inactivity and disinterest of the legislative branch.

"His justification for the moderation and control of the judiciary from implementing the constitutional Commerce Clause and Tenth Amendment was simply that in 1933 it turned out to be economically practicable to do so and "for the first time a bureaucracy could actually manage" something as striving and massive as social security. "Is it still economically feasible for the Central," [certainly not "Federal"] "Government to provide us with all of these necessary services?" (Peters, 1985)."
