One of the major issues is whether the JCPC and the Supreme Court of Canada have strictly followed The British North America Act of 1867 (The Canadian Constitution) or whether the judges in the JCPC and the Supreme Court of Canada have made their decisions based on the prevailing social, economic and political currents of the time in Canadian society."
