This paper presents several legal arguments for abolishing the death penalty. The paper argues that the death penalty is against the law because it is a form of cruel and unusual punishment, its application tends to be arbitrary and it does nothing to reduce crime rates.

"In this time of widely televised media events surrounding the attempts to preserve one woman's life, it seems somewhat fatuous to have to make the case for abolition of the death penalty. I have to admit I find it somewhat ironic that two of the most powerful campaigners against recent attempts to remove the feeding tube from Terri Schiavo, President George W. Bush and his brother, Florida Governor Jeb Bush, are both active proponents of the death penalty, and in their times have presided over two of the states which perform the most executions (Texas and Florida). If you are a religious person, no matter what religion you are, there is some element of the redemptive power of your higher being, and no one is to be considered beyond repentance and forgiveness. But such comparisons to religions and the Schiavo case result in this kind of argument become one based only on emotion and not on hard facts. It is for this reason that I will limit my arguments against the death penalty to the legal arena only."
