This paper examines the philosophy of legalism and its origins from Confuscianism. The paper goes on to discuss the teachings of the famous third great Confuscianist in history, Hsun Tzu. The paper then examines how Confuscius's original tenets were expanded upon by Menscius. Lastly the paper explores how legalism influenced the institutionalization of custom and ritual in Chinese society.

"The fundamental tenet of the legalists was based on the early Confucianists, Confucius and Mencius, who believed that human beings were fundamentally good, innately equipped with moral virtue. The third great Confucianist in history, Hsun Tzu, 298-238 BC, believed the opposite "that all human beings were born fundamentally depraved, selfish, greedy, and lustful (Legalism, 2008)." However, this did not mean that humans were beyond hope; he thought they had the ability to be good, but had to be taught or ruled to be so, and this is how Hsun Tzu originally applied legalism, as an overbearing attempt at imposing the will of the government on the people."
