"In the case wherein a high performing school is closing because of low enrollment (8:1 student to teacher ratio) and the school system claims that it is too expensive to maintain the school, there is no provision whatsoever in the NCLB to "force" the students of the closing school to attend a low performing school. As stated in NCLB section 1116, the school authorities are mandated to provide students the option to transfer to a high performing school. Although the provision dealt with transfer from low performing school to high performing school not as a result of school closing due to financial viability, this section could be use still because it means that students should and must always be afforded the chance to enter high performing schools."
