The paper considers questions which arose from the Supreme Court's decision, such as whether the EPA possesses the authority to regulate greenhouse gas emissions internationally and whether the U.S. government has the right and/or power to force its own greenhouse gas emission policies on other countries, such as China, India and Africa. "The legal basis of this important case revolves around the state of Massachusetts and its lawsuit against the U.S. Environmental Protection Agency which was sued for failing to regulate the emissions of four common greenhouse gases which have been shown to increase the effects of global warming, one in particular being carbon dioxide (CO2) which is emitted by coal-burning plants that generate electricity for U.S. cities and from automobiles powered by internal combustion engines.
"Generally, the petitioners sued the EPA because they claimed that CO2 and related greenhouse gases were negatively affecting the earth's atmosphere and would at some point in the future cause sea levels to rise, thus affecting the shoreline of the state of Massachusetts and other Eastern Seaboard states. This case ended up at the U.S. Supreme Court which on April 2, 2007, in a 5 to 4 decision, ruled in favor of Massachusetts and other petitioners, meaning that the EPA must do everything in its power to regulate the emission of greenhouse gases."
