"Our very historical and present consciousness of the balance in the use of intellectual property law is tied up with seeking that middle ground that gives artists, inventors, and other creative thinkers the rights they deserve, but still supports and protects fair use rights and a rich public commons. Such a balance is easier said than done, of course, especially as our technology continues to thrive, and our information-based economy is changed by the way we exchange thoughts, ideas and information.
"We must use our knowledge of the history of intellectual property law, and its future, in order to find creative ways to use the law rather than just using the law as a "big stick" to quiet any perceived threats. Communication technology is here to stay, and outlawing it or modifying it drastically will create far worse problems in personal freedoms (of speech for example) than it will solve for the on-going issue of piracy."
