This paper looks at five capstone cases and provides a summary on each one. It looks at the following cases: "State v. Kobel" (1996); "Johnson v. State" (1995), "Texas V Johnson" (1989), "State v. Thornton" (1987) and "Chicago v. Morales" (1999).
From the Paper:
"During a protest against President Ronald Reagan's administration policies in 1984, Gregory Lee Johnson burned an American flag in front of the Dallas, Texas City Hall. None of the people present had any physical injuries or even the threat of an injury. Johnson was arrested, tried, and convicted of a Texas law that prohibits the desecration of the American flag and received a one year sentence in jail and also received a fine of $2,000. "
